TERMS & CONDITIONS

Platform, ticket, event and webshop terms of ZNW BV

1. IDENTITY AND SCOPE

These terms & conditions apply to any use of the platform of ZNW BV (Heilig-Kruisstraat 12, 2640 Mortsel, Belgium, company/VAT number BE 1028.392.713, info@zonnewende.club) — including the websites zonnewende.club and tickets.zonnewende.be, the ZNW webshop and all Zonnewende events (Zonnewende Festival, Zonnewende On The Beach, Zonnewende × Garage Club and other events organised by ZNW).

By ordering a ticket or product, or by using the platform, you accept these terms. Deviations apply only if agreed in writing. In addition to these terms, our privacy policy applies and forms an integral part of every agreement.

These terms consist of: Part A (platform and general), Part B (tickets and events), Part C (webshop/merch), Part D (common provisions).

PART A — PLATFORM AND GENERAL

A.1 Use of the platform

  • The platform is intended for personal, non-commercial use. Scraping, automated extraction, or circumventing technical protection is prohibited.
  • ZNW strives for correct and current information (dates, line-ups, prices) but may correct material errors; obvious mistakes (e.g. a price of € 0.01) do not bind ZNW.
  • Features such as "My Lineup" are stored locally on your device; ZNW gives no guarantee that this data will be preserved.

A.2 Intellectual property

All trademarks, logos (including the ZNW monogram and Zonnewende wordmark), texts, images, videos, aftermovies, visual identity and software on the platform are protected by intellectual property rights of ZNW or its licensors. Any reproduction or public use without prior written consent is prohibited, except sharing on social media with clear credit and without modification.

A.3 User-generated content (UGC)

When you publicly share content (photos, videos, posts) and tag or mention ZNW (e.g. @zonnewende.club or an event hashtag), you grant ZNW a free, non-exclusive, worldwide licence to re-share and use that content to promote ZNW and its events, with credit where reasonably possible. You can withdraw this licence for future use via info@zonnewende.club; already published re-use will then be removed within a reasonable period. You warrant that you hold the necessary rights to the content you share.

PART B — TICKETS AND EVENTS

B.1 Ordering and delivery of tickets

  • Tickets are sold through our official channel (tickets.zonnewende.be) or official partners designated by ZNW. The agreement is concluded upon payment confirmation; you receive your e-ticket by email.
  • Check your order (event, date, quantity, type) before paying; obvious ordering errors can only be corrected as long as the event allows it.
  • Prices shown include VAT and exclude any clearly indicated service or transaction fees.

B.2 No right of withdrawal

In accordance with article VI.53, 12° of the Belgian Code of Economic Law, there is no right of withdrawal for tickets for leisure activities with a specific date or period. All ticket sales are final; tickets are not refunded or exchanged, except as set out in B.5.

B.3 Resale

Reselling tickets above the original price, and regular resale, is prohibited (Belgian Act of 30 July 2013 on the resale of admission tickets). ZNW may invalidate tickets offered in breach of this rule without compensation. Occasional resale at no more than the original price is permitted; name changes are only possible via the procedure provided by ZNW, where offered.

B.4 Access and house rules

  • Access only with a valid, undamaged ticket (first scan counts) and, where requested, valid ID. Some events have a minimum age (incl. Zonnewende × Garage Club: strictly 18+); without valid proof of age, access can be refused without refund.
  • The organisation and security may carry out clothing/bag checks and searches at the entrance in accordance with the law; refusal may lead to denied access without refund.
  • Prohibited: drugs, weapons, glass, own drinks and food (except for medical necessity), professional recording equipment without accreditation, lasers, fireworks, and any behaviour endangering the safety or comfort of others. Event-specific house rules (e.g. "no phones on the floor" at Garage Club, in=in/out=out, last entry times) are announced on site and/or on the event page and form part of these terms.
  • In case of violations the organisation may refuse access or remove you from the site, without refund and without prejudice to damages or reporting to authorities where appropriate.
  • You enter the event at your own risk. Protect your hearing; earplugs are recommended and available where possible. Sound levels are managed in accordance with applicable regulations.

B.5 Changes, rescheduling and cancellation

  • Line-up, timetable and site layout may change. The change or cancellation of (an) artist(s) does not entitle you to a refund; the event as a whole remains the essence of the agreement.
  • If ZNW cancels an event entirely, the ticket price (excl. services already delivered and service fees where legally permitted) is refunded via the original payment method within a reasonable period after the announcement.
  • If an event is rescheduled, your ticket remains valid for the new date; if you cannot attend the new date, you will be offered a refund during a reasonable period communicated by ZNW.
  • Force majeure (incl. extreme weather, government decisions, epidemics, safety risks, strikes, utility failures) may lead to changed opening hours, interruption, partial or full termination. If an event is stopped after it has substantially taken place, no refund is due; in other cases ZNW will seek a fair solution in accordance with applicable law.

B.6 Recordings at events

Photo and video recordings are made at events in which visitors may be recognisable; these may be used for reporting and promotion as described in our privacy policy (which includes your rights, such as removal of targeted images on request). By entering the event you acknowledge that you have been informed of this.

B.7 Liability at events

ZNW is only liable for damage caused by its proven fault and — except in cases of intent, gross negligence or personal injury — up to the amount of your ticket. ZNW is not liable for loss, theft or damage to personal belongings, nor for damage caused by other visitors or external circumstances. Use of lockers, campsites, parking and transport (shuttles) is subject to the conditions applicable there.

PART C — WEBSHOP (ZNW MERCH)

C.1 Offer and ordering

  • The offer (incl. the ZF26 collection) is valid while stocks last; drops may be limited and are not reprinted ("never restocked"). Colours may differ slightly from product photos and videos; merchandise is hand screen-printed and small variations are inherent to the product.
  • The agreement is concluded upon order confirmation by email. ZNW may refuse orders in case of serious suspicion of abuse, bulk resale or force majeure.

C.2 Prices and payment

Prices are in euro, including VAT and excluding shipping costs, which are clearly shown before you complete your order (indicative: Belgium & Netherlands € 4.95; rest of the EU € 9.95; free EU shipping from € 50). Payment is made via the secure payment methods offered.

C.3 Delivery

Indicative delivery time: 2–3 working days for Belgium and the Netherlands after dispatch, longer for other EU countries; delivery times are indicative and not of the essence. Statutory maximum delivery time: 30 days, unless agreed otherwise (e.g. pre-order with a stated delivery date). Risk passes upon delivery. Check the shipment upon receipt and report transport damage as soon as possible.

C.4 Right of withdrawal and returns

  • Statutory right of withdrawal: as a consumer you have the right to withdraw from your purchase within 14 calendar days of delivery without giving reasons. Use the model form in the annex or email info@zonnewende.club. Return shipment must be made within 14 days of your notice; the direct cost of returning is at your expense unless stated otherwise.
  • Extended ZNW return policy: on top of the statutory minimum, ZNW accepts returns of unworn items with original labels up to 30 days after the drop closes, as stated on the webshop.
  • Refunds are made within 14 days of your withdrawal via the original payment method; ZNW may withhold the refund until it has received the goods or proof of shipment. A deduction may be applied for depreciation caused by use beyond what is necessary.
  • Exceptions: personalised or made-to-measure items, and sealed items that cannot be returned for hygiene reasons once unsealed, are excluded from withdrawal.

C.5 Conformity and warranty

The statutory 2-year warranty for consumer goods applies. Report a defect within a reasonable time (we recommend within 2 months of discovery) via info@zonnewende.club with photos and your order number; ZNW will repair, replace or — where impossible or disproportionate — offer an appropriate price reduction or refund. Normal wear, incorrect washing (follow the care label) or damage caused by you are not covered.

PART D — COMMON PROVISIONS

D.1 Platform liability

The platform is provided "as is". ZNW strives for maximum availability but does not guarantee uninterrupted or error-free operation and — except in cases of intent or gross negligence — is not liable for indirect damage (data loss, missed opportunities). Links and embeds to third-party services (incl. Spotify, social media, ticketing and payment partners) are subject to those third parties' terms.

D.2 Force majeure

Neither party is liable for failures caused by force majeure. Obligations are suspended for as long as the force majeure lasts; if it lasts longer than 90 days, either party may terminate the affected agreement without compensation, without prejudice to the event arrangements in B.5.

D.3 Complaints and disputes

  • Complaints: email info@zonnewende.club; we confirm receipt and aim to resolve within 14 days.
  • Consumers can also contact the Belgian Consumer Mediation Service (consumerombudsman.be) and the European ODR platform (ec.europa.eu/odr).
  • These terms are governed by Belgian law. Disputes fall under the jurisdiction of the courts of the judicial district of Antwerp, without prejudice to mandatory jurisdiction rules protecting consumers.

D.4 Final provisions

If any provision is void, the remaining provisions remain in force and the void provision is replaced by a valid one that approximates its purpose as closely as possible. ZNW may amend these terms; the version applicable at the time of your order continues to apply to that order. The current version is always available on the platform.
